Senate passes landmark Human Rights Bill: Will Ahmadies get their rights?

Dawn.com ISLAMABAD: The Senate on Friday approved a formation of the Human Rights Commission, DawnNews reported.

 

A meeting of the upper house was chaired by Farooq H. Naiq here. According to the unanimously approved Human Rights Bill 2012, no intelligence agencies would be able to detain any citizen illegally.

The bill also stated that the Pakistan’s armed forces and intelligence agencies would be answerable to the commission and the parliament.

The commission could survey any jail or any clandestine prison to check illegal confinements, it added.

The bill would also restrict foreign funding to the NGOs in the country without prior approval.

  1. Human rights are for humans because Ahmadis are either not humans or considered as humans in sunnastan where ahle sunnat waljamaat is now banned because of its unholy services to Islam or terrorism. God save the world from adeemussama mullahs.

  2. How would this relate to the infamous ‘blasphemy’ laws? Isn’t this contradicting it?

  3. How can Ahmadis be given their human rights in Pakistan when:-

    (1) The Government is a Mullah Sympathizer
    (2) Ahmadis are “Constitutionally and legally NOT MUSLIMS” and
    (3) The Mullahs’ religion is to kill everybody who differs with them.

    Irony of the situation in Pakistan is Lack of Logic; Mullah – has proven to be a symbol of “Morbid Cruelty” and “State like Powers” have been given to him in Pakistan.

    Mullahs played no positive role in Pakistani Politics (before or after August 14, 1947). Then Bhutto in pursuit of his fallacy to win a place in history as “ruler of the masses” bent and bowed before Mullahs. Alas – he did gain a place in history albeit for being a “divider, suppressor and destroyer of the statutory civil bonds”.

    Those were the days and they are gone by – when (HRCP) Human Rights Commission of Pakistan did an excellent job when it was in the hands of I. A. Rehman; Salima Hashmi; Aasma Jehangir; Zafar Chaudhry; and other like minded people around them.

    Now an HRCP operated by the Mullah Sympathizer Government of Pakistan – what should one be expecting ???

  4. Yes, they are Mullah-Sympathizers in the politest way to say it. Otherwise, one has to look back in the history to understand that:-

    1. March 1949:-
    Objectives Resolution was adopted by the Constituent Assembly of Pakistan on March 12, 1949; an attempt to make Religion “a business of the Government”.

    2. March 1953:-
    Anti-Ahmadiyya Agitation was “sponsored and launched” by the Provincial Government of Mian Mumtaz Mohammad Khan Daultana in Punjab and Martial Law was imposed in Lahore on March 06, 1953. How many lives were lost, how much of private property was looted and burnt at the “set free” hands of Mullahs.

    3. April 1973:-
    Azad Kashmir Assembly adopted a resolution to declare Ahmadis as “Not Muslims” – tabled by the Government of (Mullah) Sardar Abdul Qayyum on April 29, 1973; which served to pave the legislative way for enactment by the National Assembly of Pakistan.

    4. July 1974:-
    PPP Government of Bhutto sponsored the Mullahs to boycott Ahmadis, to loot their properties, to attempt on their lives and at the same time ordered the police not to intervene with Mullahs’ actions. How many persons were killed by Mullahs while Police played “on lookers”? Did Bhutto Government not provide absolute liberty to Mullahs to propagate, instigate and generate hatred against Ahmadis?

    5. September 1974:-
    PPP Government of Bhutto amended the national constitution to declare Ahmadis as “Not Muslims for the Constitutional and Legal Purposes” on September 07, 1974.
    Did he not celebrate the day as much with Mullahs – as one big victory in the last 90 years?
    It will be interesting to read the account of that evening in Kauser Niazi’s book – Aur Line Kut Gai.

    6. July 1977:-
    100% of General Zia ul Haque’s cabinet positions were filled from within the Mullah Parties (segments of PNA).

    7. April 1980:-
    The country was for the first time ruled by all those (including General Zia ul Haque) who were from the progeny of Anti-Pakistan Families and Political Parties.

    8. April 1984:-
    Anti Ahmadiyya Ordinance was promulgated on 26 April 1984 by the Government of General Zia ul Haque; that seized all civil and religious rights from Ahmadis and PROVIDED LEGAL SUPPORT TO MULLAHS TO PESECUTE, HARM, HATE, INSULT AND DESTROY ANY AHMADI AND ALSO IMPRESSED UPON AHMADIS TO SIGN DEROGATORY STATEMENTS AGAINST THEIR RELIGION AND BELIEF. Since that day they are “officially” refused entry to schools, colleges, universities, civil and military employment, and to practice any of their religious rites.

    9. March 1985:-
    Objectives Resolution of 1949 was officially annexed to the Constitution of Pakistan with effective from March 02, 1985 and “Religion became official business of the Sate of Pakistan”.

    10. 1977 to Present:-
    Every single Mullah Party big or small publically accepts and attributes General Zial ul Haque as their “Creator” and “Patron”.
    Do the Mullah Parties not claim that the Government of General Zia ul Haque give them land, money, ammunition and training?

    Is Pakistani Tehrike Taliban, Sipahe Sahaba, Jamaa’t Dawa, etc. etc. a whole big series of such names not based in Punjab Province that is ruled by the Sharif Brothers’ Muslim League (N) Party; which is the “friendly opposition” to the Federals.

    And is JUI (Fazal ur Rehman) not part of the Federal Government?

    Will somebody be still so simple to question – Sympathy or Cowardice?

    • Excellent summary of what went on in Pakistan. May be this can be turned into an article. I agree with you. Pakistani state is unfortunately an active collabaroter in this whole ugly saga. Starting right from Mumtaz Daultana, the chief minister of Punjab who was actively behind the hate campaign against ahmadies upto now, shahbaz sharif, this is a well established fact. However only Pakitanis and that also Ahmadies, with some exceptions can really understand this well. I am however, rather curious about what really went on with Sir Zafarullah Khan’s support to objective resolution. Did he really support it? Many human rights people qoute this as an example of ahmadies being short sighted also (see my posting” the apostates of Pakistan” yesterday. Can someone explain?

  5. We are commenting on the events some 30 to 60 years after their happening. It is just like looking in the back view mirror of a vehicle. Pretext to and the background of many of those events stood or was deemed to have stood different as is sometimes thought to have been. Also, it was not necessarily as simple a situation as is thought by many.

    For example, the Objectives Resolution of 1949 is a good example:-

    It can be said today that it might have been good if it was neither presented nor adopted – BUT – It was presented and was presented in a peculiar atmosphere of doubt that what the Muslims’ Majority in Pakistan is going to inflict upon the minorities like Hindus while the massacre of 1947 stood in the immediate background.

    It was then an ongoing International Propaganda Campaign lead by the Indian lobby. Amidst that situation, the resolution was presented with a grand fervor of Islamic Teachings of Social Justice. That is why it was ratified by EVEN the Hindu members of the Legislature, leave alone Sir Muhammad ZafarUllah khan.

    How would anyone think Sir Muhammad ZafarUllah khan not supporting it, at that time in that given situation?

    The trouble however came when Legislative Process was hampered, Constitution Writing was delayed and Mullah Parties started assigning and adding meanings to the text of the adopted resolution. Just as they have unfortunately done with the Straight and Simple Teachings of the Holy Quraan.

    When General Zial ul Haque annexed the resolution to the constitution through his Presidential Order, the word “FREELY” as it stands in the clause 4 of the resolution {for the minorities to freely profess and } was removed from its text. It was later on “INSERTED BACK” by 18th amendment to the constitution.

    Below is the text of the Objectives Resolution (some may have not read it before).

    Whereas sovereignty over the entire universe belongs to Allah Almighty alone and the authority which He has delegated to the State of Pakistan, through its people for being exercised within the limits prescribed by Him is a sacred trust; This Constituent Assembly representing the people of Pakistan resolves to frame a Constitution for the sovereign independent State of Pakistan;

    1. Wherein the State shall exercise its powers and authority through the chosen representatives of the people;

    2. Wherein the principles of democracy, freedom, equality, tolerance and social justice as enunciated by Islam shall be fully observed;

    3. Wherein the Muslims shall be enabled to order their lives in the individual and collective spheres in accordance with the teachings and requirements of Islam as set out in the Holy Quran and the Sunnah;

    4. Wherein adequate provision shall be made for the minorities to freely profess and practice their religions and develop their cultures;

    5. Wherein the territories now included in or in accession with Pakistan and such other territories as may hereafter be included in or accede to Pakistan shall form a Federation wherein the units will be autonomous with such boundaries and limitations on their powers and authority as may be prescribed;

    6. Wherein shall be guaranteed fundamental rights including equality of status, of opportunity and before law, social, economic and political justice, and freedom of thought, expression, belief, faith, worship and association, subject to law and public morality;

    7. Wherein adequate provisions shall be made to safeguard the legitimate interests of minorities and backward and depressed classes;

    8. Wherein the independence of the Judiciary shall be fully secured;

    9. Wherein the integrity of the territories of the Federation, its independence and all its rights including its sovereign rights on land, sea and air shall be safeguarded;

    So that the people of Pakistan may prosper and attain their rightful and honored place amongst the nations of the World and make their full contribution towards international peace and progress and happiness of humanity.

    Hope it suffices as an explanation.

    • Many thanks Mr. Pervaiz for this enlightening short answer. Quoting issues out of context is long a practice of people who wish to dis-inform. Such is the case, also, where there is a constant harping by these people on the fact that the Sir Zafarullah did not participate in the burial prayers of Jinnah. Obviously in the long run perhaps all these stands taken by the Ahmadiyya community will be vindicated. Inshallah. Jazkallah

  6. Khan Abdul Wali Khan was the only leader who openly opposed the 1974 anti-Ahmadiyya resolution. He voted against it & refused to sign the final document.
    In return the Jamaat has never complimented him. In fact we have not even acknowledged his favorable role as a Jamaat. Ahmadis have never voted for Awami National Party (ANP), the party of Wali Khan.
    When People Party abandoned them,the we left in cold. Still, majority of Ahmadi politicians support Bhutto-Party. For foreseeable future,the mullah will have the upper hand.

  7. Funeral Prayer of Quaide Azam Muhammad Ali Jinnah – AND – Sir Muhammad ZafarUllah Khan

    Backgrounder:-

    1. Muslim Funeral Prayer is a “Fardhe Kifaya” : Prayer in Congregation by even a few Muslims SUFFICES on behalf of the entire community, nation, country and even Ummah; whichever would be the case in a given situation.

    2. Funeral Prayer can ALSO be offered in “ABSTENTIA” once the prime congregational prayer has been offered.

    3. Every Muslim has the right to choose an Imam and congregation for ones prayers.

    4. No Muslim should be buried without offering a Funeral Prayer in congregation (no matter if the gathering is small or a big one) for the deceased.

    When a few incidents happened in Europe (during late 1960s and early 1970s) that Muslim Individuals were reportedly buried without their Funeral Prayers BECAUSE (in those days) there were hardly anybody in those remote communities and towns who knew how to lead a funeral prayer; the THIRD IMAM of Ahmadiyya Muslim Jamaat made it compulsory for all missionaries working outside Pakistan to remain watchful to ensure that NO MUSLIM (OF ANY SECTION) FOR WHOM THERE IS NO ARRANGEMENT OF A FUNERAL PRAYER, THE AHMADI MISSIONARY WILL ARRANGE TO ORGANIZE AND LEAD THE CONGREGATIONAL FUNERAL PRAYER FOR THE DECEASED. SO THAT, NO MUSLIM IS EVER BURIED WITHOUT THE FUNERAL PRAYER.

    The demise of Quaide Azam Muhammad Ali Jinnah was an enormous shock to the whole nation but his colleagues in the national cabinet and the working council were obviously the most affected ones. Sir Muhammad ZafarUllah Khan has to be counted as one of those most affected and moved people. Also because Sir Muhammad ZafarUllah Khan was affectionately nick named as “the political son of Quaide Azam”.

    In that time of extreme grief; comes the time for the funeral prayer in congregation LEAD BY MAULANA SHABBIR AHMED USMANI SAHIB; who also happened to be a FATWAe KUFR ISSUER for Ahmadis and user of harsh words for the Founder of Ahmadiyya Jamaat.

    This is the point which is (most oftenly) ignored – that how an Ahmadi could join in the congregation that is lead by a personality hostile to his belief and his Imam; while the Funeral Prayer (in principle) is a “Fardhe Kifaya”.

    BUT another point which is barely quoted by the intelligentsia is that Ahmadiyya Muslim Jamaat in Pakistan offered Feneral Prayers in Absentia in many towns, villages and cities. Dr. Pervaiz Parwazi Sahib is one prime participant in such a congregational funeral prayer held for Quadie Azam Muhammad Ali Jinnah in his village.

    Irony of many such incidents in Pakistan is that “positivity for the common good” is curbed and a scary mammoth like scenario is presented out of no context – and the story becomes “juicy” but in fact “misleading”.
    Allah may enable all of us to seek and stick to the truth. Amen.
