Can a police constable determine if someone is Muslim or infidel? IHC

Daily Times: ISLAMABAD: Islamabad High Court (IHC) on Wednesday remarked that no one had the right to “kill anyone and violate the law” as it heard convicted killer Mumtaz Qadri’s appeal against his death sentence.

 

Qadri murdered former Punjab governor Salmaan Taseer and was sentenced to death by an Anti-Terrorism Court (ATC). A two-member bench of the IHC comprising of Justice Noorul Haq Qureshi and Justice Shaukat Aziz Siddiqui heard the appeal. Qadri’s lawyer, former justice-turned-advocate Khawaja Sharif continued his argument and pleaded before the court that his client confessed his crime due to police pressure. Quoting the convicted killer’s recorded statement, Khawaja Sharif argued that his client had no personal enmity or personal clash with the deceased governor.

 

Qadri’s counsel stated that his client killed the former governor “because he expressed disrespect for Prophet Muhammad (PBUH) and termed the blasphemy law as black law”. On this point Justice Shaukat Aziz Siddiqui asked, “Does a police constable have the authority to judge the faith of anyone and to determine if one is Muslim or infidel?” He said no one was above the law. Qadri’s second defender, Nazir Akhtar, argued before the court that his client was convicted for killing the governor by ATC.

  1. This is a country with funnily contradictory laws. If the Prime Minister of the country can decide who and who is not a Muslim, why can’t Terrorist Qadri decide so?

    The law is in existence because “feelings of the Muslims” are deeply hurt when the Holy prophet (PBUH), not God;not the other prophets, is ridiculed.

    Either the law is worthless and Qadri is right OR Qadri is damn wrong and so is the law !!!

    My gut feeling is that the law will remain as is and everyone will kill (not murder) each other because somehow everyone may feel that ‘his/her feelings” were hurt in some way or another.

  3. Yes, Dr.M. Boodhun, you have described it very well. The bad legislation is at the root of all trouble. There is dog thrown in the well of drinking water.
    It has put pressure on the judiciary too. They are to give some decision. If Qadri is left off the hangman’s noose then any one will be free to kill any official. Qadri has to be punished but every one is afraid. Qadri has taken the law in his own hands and it was a bad law. But is there no other law to put the matters on right lines?
    Previously when any king died, his orders used to become null and void. The bad laws enacted by Zia ul Haque are still haunting the poor Pakistanis.
    Every one in Pakistan is insane as no one supports truth. No one has the courage. Very soon the Mullas will come out against Nawaz then he will realize that he was feeding/ supporting wrong type of people. We hope that Army will be strong against the bigots and weak, misguided politicians.

  5. Until this point judges of higher courst talking sence and logic. However all will depend on outcome of the case. Beutiful comment is, “Does a police constable have the authority to judge the faith of anyone and to determine if one is Muslim or infidel?” Obviously no one has any right to decide about the faith of any one. It is matter between creation and creator. Let us wait and see the outcome of the case.

    Blasphemy law is not even an Islamic Law, its base, however is in the Holy Bible. In the life time of Hadhrat Mohammad (SAW) not only no action ever has been taken against any blasphemer, rather رحمۃ اللعالمین offered the funeral prayer of the chief hypocrite عبد اللہ بن ابئی بن ثلول and gave his own shirt to rap his body in for burial. There are so many more incidences in the life time of the Holy Prophet Mohammad (SAW) that He never ever took any revenge from any blasphemer, so much the Makkah was full of blasphemers when it was conquered by the Holy Prophet (SAW) if blasphemy was the Islamic Law he would have make Makkah full of blood, but he said to all of them لا تثریب علیکم الیوم Go this day no blame upon you.
    Even if there were any punishment for the law which is being misused even then no person is permitted to take law in his own hand. Mumtaz Qadri being a killer, deserve Capital punishment and if forgiven to him it will amount to promote terrorism in the country.
    The blasphemy law should be repealed forthwith as it is very harmful for the peace of land.
