Bangladesh declares Jamaat-i-Islami Illegal

DHAKA: The High Court in Dhaka on Thursday declared the registration of the Jamaat-i-Islami, the country’s biggest Islamic party, as a political party with the Bangladeshi election commission as illegal.

“It is hereby declared illegal,” said Moazzem Hossain, the chief judge hearing the case.

Security was tight in the Bangladeshi capital for the occasion, with fears that the verdict could trigger fresh unrest.

The high court announced its decision on the legality of Jamaat-i-Islami after a petition was lodged arguing the party’s charter conflicted with the country’s secular constitution.

The decision could trigger fresh protests by Jamaat supporters in the politically volatile country, already reeling from deadly violence over war crime verdicts passed on Jamaat’s top leadership.

Police officers and members of the elite Rapid Action Battalion had been deployed outside the court in central Dhaka ahead of the verdict in an attempt to prevent any violence.

“We have taken adequate security measures in and around the court area,” deputy commissioner of Dhaka Metropolitan Police Maruf Hossain Sarder told AFP.

A leading Sufi group, which practices Islamic mysticism, and dozens of others filed the public interest litigation in January 2009 seeking to scrap Jamaat’s registration just days after a secular government took power.

    The largest Islamist party in Bangladesh has been banned from taking part in the forthcoming general election on the grounds that it is against secularism.

    Jamaat Islami (JI) is a key member of an alliance of opposition parties that will seek to oust the ruling Awami League at the polls later this year. Although popular support for the party is limited, its supporters can swing the result in scores of constituencies.

    The ruling by the high court in Dhaka will raise tensions in the volatile country, where rival protests and strikes have intensified in recent months.

    A report from Human Rights Watch accuses security forces of using excessive force in responding to the protests. At least 150 protesters have been killed and 2,000 injured since February.

    While large numbers of protesters have been arrested, the Bangladeshi authorities have made no meaningful efforts to hold members of the security forces accountable, the report says.

    Brad Adams, Asia director at Human Rights Watch, said street protests were likely to be more frequent in the coming months. “The risk of further violence is high … unless the government takes firm action to rein in the security forces, there is going to be a lot more blood on the streets before the year is over,” he said.

    Many of the protests have been prompted by a series of judgments by a tribunal sentencing senior JI officials to death or life imprisonment for crimes they are alleged to have committed during Bangladesh’s war of independence from Pakistan in 1971. JI opposed the split with Pakistan.

    The high court ruling comes four years after a group of former politicians and moderate Muslim leaders filed a petition seeking to cancel JI’s registration with Bangladesh’s electoral authorities, saying the party wanted to introduce sharia law in the Muslim-majority country.

  2. This article from Dawn.com has not reflected the true story. Jamaati Islam opposed Bangladesh’s independence and many of whose leaders are now facing trials or have been convicted by special war crimes tribunals. Also their constitution conflicts with the constitution of the republic of Bangladesh. So their registration has been cancelled. Those who opposed the birth of Bangladesh, has no right to do politics in the name of Islam in Bangladesh.

Bangladesh has reached a historic juncture whereas they have taken steps which will ensure the peace and strength of their country by eliminating fundamentalist and Jehady organizations such as Jama’at e Islami,which is nothing but trouble in any country, whether it be Pakistan,Egypt,Saudi Arabia or Pakistan. They have been actively involved in the nefarious crimes of creating instability and reign of terror in Pakistan for decades. Pakistan needs to root out them and other like them like the terrorists Organization of Khatme Nabuwat party.
    Earlier the better.

  4. The people and the Government of Bangladesh must have learnt many lessons from the history of Pakistan and they firmly believe in the separation of politics and religion. The Judiciary has played its due role as a result of which BD is progressing in all the fields of national life and international deals,too. One could only wish that BD enjoys full sovereign status and it plays positive unifying role in the region.

  5. Moudoodi the founder of Jamat Islami in his life up to the end preached in his writings total control and no tolerance to his opponents. He created military wings in his party in Pakistan and Bangladesh. He created a Gustapoo type atmosphere in his followers. His party created in colleges and Universities a student based organization in name of Jamieet Tuluba who believed in crushing opponents.
    Jamat Islami very successfully found common ground with military dictators and other ruling parties who ignored their activities all the time but also advised local police authorities to help them in their terrorist activities. To surprise of me and many other people this jamat was never in shortage of weapons stocks. During my student life I saw in any election time or any turmoil Jamieet students were arm to teeth with all kind of guns. University authorities including late Bhutto time were very friendly to them.
    Jamat Islami has deep resources and long tentacles extending up to Saudi Arabia and beyond. Their only object to get power one way or another way.
    Bengladesh should uproot this terrorist Nazi minded Jamat and I would say Pakistan does not follow the suit they will end up a big looser.
    This party and its founder were enemy of creation of Pakistan so you can imagine who is their boss.

  6. A bold step by BD government. Hopefully the country courts will also provide relief to Ahmadiyya Muslim Community for its religious freedom. Comments by MG Rabbi are very true and deep.

  7. Very brave step taken by BD Govrt. They have understood & seen the concept & main focus of Jamat Islami whether it is in BD or in Pakistan or in any country I suppose.

    The BD govt doesn’t want to see the future of BD like Pakistan present condition which has been destroyed by these type of extremist people.

    Nearly Pakistan Govt has lost its control in the hands of these extremists as because they have also involved themselves in politics with there wrong intentions & personal benefits who are not caring about the peace of the country.

    All the best to the Govt of Bangladesh to steadfast on its on standard & to become a true country for its own people.

  8. We Bengali people irrespective of our faith have always believed in tolerance and secularism as the backbone of Bengali nationalism. This criminal Jamaat party and its cohorts had committed atrocities of unspeakable volume in 1971 like raping women,murdering Hindu people. Bangladesh has made a tremendous progress in the last 20 years in terms of education and social factors.Literacy rate has gone up, women are held with high esteem and respect in our society.Pakistan has always created problems for us by aiding these right wing groups who have destroyed peace in our country. I hope pakistanis start taking responsibility of their actions and stop meddling in our affairs or they will end up being another afghanistan.
