International Court of Justice Rules in Favor of Palestinians and South Africa — Look at the Details

South African President Cyril Ramaphosa says the ICJ’s ruling must be respected by all who recognise the the court, including Israel.

Speaking after the court’s ruling on the application brought by his country, Ramaphosa says South Africa expects Israel, “as a self-proclaimed democracy, and as a state that respects the rule of law,” to abide by the ruling.

“Some have told us we should mind our own business and not get involved in the affairs of other countries and yet it is very much our place as the people who know too well the pain of dispossession, discrimination, state sponsored violence,” he says.

He says following the ruling, there should be more effort towards a ceasefire, and that an end to the conflict through a two-state solution that would grant Palestinians self-determination.

The European Union has published it’s initial reaction to the ICJ ruling that Israel must take all measures to prevent genocidal acts in Gaza.

“Orders of the International Court of Justice are binding,” it says, adding those party to it must comply with them.

“The EU expects their full, immediate and effective implementation,” it said in a brief statement.

  1. Hundreds of Israeli protesters have blocked some humanitarian aid trucks from entering Gaza for a third day.

    Demonstrators, including families of hostages still held in Gaza, waved Israeli flags at a key crossing and chanted against “aiding the enemy”.
    The protesters say they are demanding no aid for Gaza until all of the hostages are released.
    This comes despite a US demand that aid to civilians in Gaza be allowed to enter “without interruption”.
    For a third consecutive day, the protesters descended on the Kerem Shalom border crossing between Israel and Gaza to try to block humanitarian aid from entering the enclave.

    Reflecting on the ongoing ICJ case between South Africa and Israel, I express my disagreement with the ICJ Order in terms of justice and the rule of law as they could have done more then to stop this war. However, my comments are as follows:

    1. The court found sufficient evidence of a dispute for a genocide case, citing military operations resulting in significant casualties, massive destruction of homes, forced displacement of the population, and extensive damage to civilian infrastructure.

    2. The court specifically noted the ‘dehumanising language’ used in statements by senior Israeli officials, including references to a fight against ‘human animals.’ Israel has been ordered to take all necessary measures to prevent genocide, with a one-month deadline to report on its compliance.

    3. Additionally, the court directed Israel to prevent and punish the incitement of genocide in Gaza and take immediate, effective measures to enable the provision of basic services and humanitarian assistance in the region.

    While I may not agree with the Order from the perspective of justice and the rule of law as they could have done more to stop what is going on, it is heartening to witness the ICJ’s commitment to calling out potential breaches of international law when governments and political actors have fallen short. This case underscores the importance of international institutions in upholding accountability and justice on a global scale.
