WASHING DC – Speaking to the SFO Bay Area-based The Muslim News, Council of American Islamic Relations (CAIR) communications director Ibrahim Hooper dismissed an alleged report that CAIR took a stand a Pakistani convention on Imran Khan’s call to declare Ahmadi as non-Muslims.
Ibrahim Hooper said, “CAIR is not a Fatwa-issuing body. It is a human rights organization and we work everyone in US regardless of their faith or sect. We have in the past supported the Ahmadi Muslims in their mosque vandalism case. We do not take any such stand. We are not aware of any such convention in Pakistan.”
TMN: Do you know that criterion for being a Muslim is the recitation of the Kalima, “There’s no God but Allah and Muhammad is His Messenger.”

Hooper: Again we treat everyone alike. We even work with the Christians. There was a Christian lady in Pennsylvania – bus driver – who complained of discrimination because she wore a scarf.
In response to a fax sent by The Muslim News, the CAIR founder Nihad Awad left a voice message that he was not aware of any Pakistani convention. CAIR did not take part in such a convention and there is no CAIR presence in Pakistan. Nihad also reiterated that CAIR does not take issues on Muslim and non-Muslim questions. He added that CAIR is a human rights organization and does not get involved in these issues.

  1. That letter is interesting, carefully worded. I have seen the English version. The letter is addressed to the new self made Khalifah “Baghdadi sahib”. It is meant to solve their own problem, the problem that CAIR is facing and wants to solve care of renowned Muslim scholars. It is a much delayed step in the right direction. Such things are needed.
    In the beginning of the letter, the scholars (for CAIR) have defined a few rules to make themselves assertive by a summary. In the letter also they have presented some arguments in own support by use of Hadith and Quran.
    I am presenting the beginning part of the document (Summary only).
    It is note worthy that they did not mention about any one changing his religion. They have missed out the correct punishment for apostasy.
    The letter however mentions that nobody is to say any one is non Muslim, unless that person himself says he is not a Muslim. See No. 9 below:

    Executive Summary
    1- It is forbidden in Islam to issue fatwas without all the necessary learning requirements. Even then fatwas must follow Islamic legal theory as defined in the Classical texts. It is also forbidden to cite a portion of a verse from the Qur’an—or part of a verse—to derive a ruling without looking at everything that the Qur’an and Hadith teach related to that matter. In other words, there are strict subjective and objective prerequisites for fatwas, and one cannot ‘cherry-pick’ Qur’anic verses for legal arguments without considering the entire Qur’an and Hadith.
    2- It is forbidden in Islam to issue legal rulings about anything without mastery of the Arabic language.
    3- It is forbidden in Islam to oversimplify Shari’ah matters and ignore established Islamic sciences.
    4- It is permissible in Islam [for scholars] to differ on any matter, except those fundamentals of religion that all Muslims must know.
    5- It is forbidden in Islam to ignore the reality of contemporary times when deriving legal rulings.
    6- It is forbidden in Islam to kill the innocent.
    7- It is forbidden in Islam to kill emissaries, ambassadors, and diplomats; hence it is forbidden to kill journalists and aid workers.
    8- Jihad in Islam is defensive war. It is not permissible without the right cause, the right purpose and without the right rules of conduct.
    9- It is forbidden in Islam to declare people non-Muslim unless he (or she) openly declares disbelief.
    10- It is forbidden in Islam to harm or mistreat—in any way—Christians or any ‘People of the Scripture’.
    11- It is obligatory to consider Yazidis as People of the Scripture.
    12- The re-introduction of slavery is forbidden in Islam. It was abolished by universal consensus.
    13- It is forbidden in Islam to force people to convert.
    14- It is forbidden in Islam to deny women their rights.
    15- It is forbidden in Islam to deny children their rights.
    16- It is forbidden in Islam to enact legal punishments (hudud) without following the correct procedures that ensure justice and mercy.
    17- It is forbidden in Islam to torture people.
    18- It is forbidden in Islam to disfigure the dead.
    19- It is forbidden in Islam to attribute evil acts to God .
    20- It is forbidden in Islam to destroy the graves and shrines of Prophets and Companions.
    21- Armed insurrection is forbidden in Islam for any reason other than clear disbelief by the ruler and not allowing people to pray.
    22- It is forbidden in Islam to declare a caliphate without consensus from all Muslims.
    23- Loyalty to one’s nation is permissible in Islam.
    24- After the death of the Prophet , Islam does not require anyone to emigrate anywhere.

    Now that CAIR persons are saying they are not Fatwa issuing people. Whatever they have presented to Baghdadi sahib, if it is not a Fatwa then it may be some opinion only or vain sermon.
    What use was the letter if it cannot be taken as a meaningful document.
    It is okay to avoid calling it a Fatwa. But still it has some authority. Otherwise it will be useless paper.

    In the executive summary, some one has summarized the important teachings of Islam (even though they left out some loop holes.)
    In the last point they had tried to give guidance about the establishment of Khilafat. I hope that is meant to point to the self made Khilafat of Baghdadi sahib.
    I had noted that it was a step in the right direction, to guide the Muslims towards the beautiful teachings of Islam. Let us see what effect it will have on the health of ISIS Khilafat.
    I wonder that there is not even one Mufti amongst the signatories. (I have not checked all.)
