Indonesia. KY Asked to Monitor Judges Who Tried Cases of Destruction of Mosques in Sintang

TRIBUNNEWS.COM, JAKARTA – The Advocacy Team for Freedom of Religion and Belief encouraged the Judicial Commission (KY) to monitor the performance of the panel of judges who served at the Pontianak District Court.

This is because they saw irregularities in the examination process in the trial of the defendant for the destruction of the Miftahul Huda Mosque in Balai Harapan Village, Sintang Regency , West Kalimantan , which was built by the Ahmadiyya community .

“The panel of judges does not delve into criminal acts of vandalism and incitement to violence as charged by the public prosecutor,” said the representative of the Advocacy Team for Freedom of Religion and Belief when submitting a complaint to KY, Thursday (16/12/2021).

In their observation, the advocacy team considered the Panel of Judges to have cornered the Ahmadiyah witness by questioning his religious beliefs.

“The panel of judges and prosecutors also asked a lot of questions about the beliefs of the victim witnesses from the Ahmadiyya Muslim side , not in the incidents of violence and destruction themselves,” he said.

Furthermore, they said, the trial process seemed to shift from adjudicating incidents of violence and vandalism to adjudicating the beliefs of the victims.

“This is marked by the panel of judges presenting factual witnesses from the MUI who were not involved in the violent incident on September 3, 2021,” they said.

For information, the Advocacy team for Freedom of Religion and Belief itself is composed of YLBHI, PB JAI Legal Committee, KontraS, Setara Institute, Imparsial, AMAN Indonesia, HRWG, One Justice Foundation, Inclusive Foundation, Paritas Institute, HRW, and SEJUK.

Based on these findings, the advocacy team for Advocacy for Freedom of Religion and Belief asked KY to carry out the trial process because it was suspected that there was a violation of the judge’s code of ethics in this trial.https://www.youtube.com/embed/3RCITdUq2mw

Not only that, the Advocacy team for Freedom of Religion and Belief has also held a press conference at the Komnas Perempuan Office Jl. Latuharhari, Central Jakarta, on Wednesday (15/12/2021).

“Ask the Indonesian Judicial Commission to carry out monitoring and supervision of this case as a form of maintaining honor and dignity and behavior,” he said.
