YLBHI says this violates the Indonesian constitution

Bandung, IDN Times – Unpleasant news has again been experienced by the Ahmadiyah Parakansalak congregation, Sukabumi Regency. They were banned from holding the 79th Indonesian Independence Bazaar Festivities through two letters, the village head and the Sub-district Leadership Communication Forum (Forkopicam).

Based on the letter received by IDN Times, the Head of Parakansalak Village, Rini Mulyani, also directly signed the prohibition letter numbered 900/Y8/Pemdes-VIII/2024 accompanied by a wet stamp. The Forkopicam letter was also completed with a signature and wet stamp.

1. Sales of basic necessities are only carried out for Ahmadiyah congregations

Asep Saepudin as the leader of the Parakansalak Ahmadiyah Congregation said that the lively bazaar in commemoration of the 79th Indonesian Independence Day could not be held due to the issuance of a Letter from the Village Head and Forkopicam. However, the sale will still be carried out.

“The sale of basic necessities will still be carried out for internal congregations. If there are residents who are enthusiastic and intend to buy basic necessities, they will be served like buyers,” said Asep through an official statement, Saturday (10/8/2024).

Meanwhile, the General Chairperson of the Indonesian Legal Aid Foundation (YLBHI) Muhamad Isnur said that the ban on cheap basic food bazaars, as a social action by the Ahmadiyah congregation to help fellow citizens who are economically disadvantaged, which is planned to be held on Sunday, August 11, 2024, is a form of discrimination, crime, and exclusion of citizens who truly love the Republic of Indonesia.

“Public participation is guaranteed by the constitution. This ban violates the 1945 Constitution. What is very sad is that this discrimination is carried out only because of differences and diversity of beliefs,” Isnur said as quoted from an official statement, Saturday (10/8/2024).

To ensure that the Ahmadiyah congregation’s right to participate is protected, Isnur emphasized that every citizen, including the Ahmadiyah congregation, is free to carry out peaceful activities that are not criminal acts at all.

“Therefore, the central government (President, Ministry of Home Affairs, Police, TNI) and the Indonesian Ombudsman must impose sanctions and strong reprimands on the Head of Parakansalak Village and Forkopicam. The government cannot ignore certain government officials who carry out discriminatory practices in the name of belief,” he said.

3. The state must facilitate its citizens in expressing themselves.

The ban on the Ahmadiyah Parakansalak congregation from holding a basic food bazaar by the local government based on discriminatory regulations, namely the 2008 Joint Decree on Ahmadiyah, the 2011 West Java Governor Regulation on the prohibition of Ahmadiyah activities, and the Sukabumi Regency Regulation on Public Order and Public Order, is null and void by the highest law, the Constitution of the Republic of Indonesia.

The state, said Isnur, should actively educate and provide spaces for diversity dialogue when conflicts occur in society, not marginalize small groups and prioritize the interests of dominant groups of citizens, the majority.

The state is also responsible for facilitating every citizen to freely express themselves and participate in social-community activities.

“Yes, this is a very sad event, it makes us very angry and furious at certain officers who violate the rights of their citizens in the name of beliefs that are truly very diverse and must be respected by the state,” said Isnur.
